1. Scope of Application
The following terms and conditions apply to the online purchase of tickets for events organized by Anne Mehlinger and Analia Celeste Muniz via the Burlesque Cologne website, hereinafter referred to as “Burlesque Cologne.” These terms and conditions specifically govern the formation of the contract between you and Burlesque Cologne. They apply to all orders placed by consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. The privacy policy applicable to the use of the website, including information on the type, scope, and purpose of the collection and use of your personal data, is also part of these terms and conditions. These terms and conditions also apply if access to the website is obtained from outside the Federal Republic of Germany.
2. Availability
We strive to maintain constant availability of our website within the limits of technical possibilities.
However, maintenance, security, or capacity issues may result in short-term disruptions or temporary unavailability. Legal provisions regarding digital products remain unaffected.
3. Concept
We sell tickets for workshops and dance events. Detailed descriptions of individual workshops are provided with each event. The events featuring dance performances and various burlesque artists are also described for the respective events. The representations used for promotional purposes provide an impression of the events. As this is an artistic representation, it is not an exact depiction but merely a similar representation.
4. Contractual Partner, Conclusion of Contract
The contract is concluded with Burlesque Cologne. The presentation of individual products on the website constitutes a binding offer to conclude a contract for the purchase of tickets. You can click on a product without obligation and review and correct your entries at any time before submitting your binding order. The contract is concluded when you accept the offer by clicking the “place order” button and then entering your data with PayPal and completing the payment process there.
Confirmation of receipt of your order is sent by email immediately after the order is submitted.
5. Contract Language, Storage of Contract Text
The languages available for the conclusion of the contract are German and English. We store the contract text and send you the order data and the present terms and conditions by email. You can save the contract text on a permanent data carrier if needed.
6. Registration Option
Currently, no registration is offered for selecting and ordering products.
7. Payment
In cooperation with PayPal, we generally offer you the following payment methods:
PayPal The “PayPal” payment method is an option via PayPal CHECKOUT. During your order in our online shop, you will automatically be redirected to PayPal’s payment page. There, you will be asked to log in with your details to execute the payment. After the payment confirmation, we will execute the order for you. To pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate with your access data, and confirm the payment instruction.
The payment transaction will be executed by PayPal immediately after the order is placed. Further information can be found in the order process.
SEPA Direct Debit via PayPal CHECKOUT The “SEPA Direct Debit” payment method is an option via PayPal CHECKOUT. You do not need a PayPal account to shop with “SEPA Direct Debit” with us. During the checkout process, after selecting the “SEPA Direct Debit” payment method, you will automatically be redirected to PayPal’s payment page. You pay the purchase price quickly and securely by entering your bank details at the end of your order. Immediately after the transaction, you will receive a confirmation email from PayPal. In addition to the transaction amount, you will also find the due date of the payment there. PayPal will also remind you 4 days before this due date of the upcoming direct debit. After payment is completed, we will execute the order for you.
Credit Card via PayPal CHECKOUT The “Credit Card” payment method is an option via PayPal CHECKOUT. You do not need a PayPal account to shop with a “Credit Card” with us. PayPal accepts credit cards from MasterCard, Visa, and American Express. During the checkout process, after selecting the “Credit Card” payment method, you will automatically be redirected to PayPal’s payment page. You enter your credit card details during the order process. Your card will be charged immediately after the order is placed.
8. Ticket Delivery
After completing your order, you will receive your ticket by email.
9. No Right of Withdrawal
The event is related to leisure activities that require the agreement of a specific date. Therefore, the binding ticket order involves the provision of capacities. For this reason, there is no statutory right of withdrawal according to § 312g Abs. 2 Nr. 9 BGB after the online order has been placed.
10. Prohibition of Commercial Resale
The commercial resale of tickets is prohibited.
11. Force Majeure
We reserve the right to withdraw from the contract or cancel the event at short notice if the organization and execution of the event cannot be objectively guaranteed due to force majeure or other circumstances beyond our control, such as natural disasters, epidemics, war, fire. In such cases, we will inform you immediately upon becoming aware of the aforementioned circumstances and refund any payments made without delay. The liability provisions in Section 13 of these terms and conditions remain unaffected.
12. Warranty
The statutory warranty law applies.
13. Liability, Limitation of Liability
Claims for damages against Burlesque Cologne are excluded unless otherwise specified below. This exclusion does not apply to claims for damages arising from injury to life, body, or health or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages based on an intentional or grossly negligent breach of duty by Burlesque Cologne or a legal representative or vicarious agent of Burlesque Cologne. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. In the event of a breach of essential contractual obligations, Burlesque Cologne is only liable for foreseeable damage typical of the contract if this was caused by simple negligence unless it concerns claims for damages arising from injury to life, body, or health. The limitations of the preceding paragraphs also apply in favor of the legal representatives and vicarious agents of Burlesque Cologne if claims are asserted directly against them.
14. Hyperlinks
On our website, hyperlinks to third-party websites may be provided on a case-by-case basis. These are exclusively external content for which Burlesque Cologne cannot guarantee the accuracy and/or legality. In particular, Burlesque Cologne cannot control such content and does not adopt it under any circumstances.
15. General Provisions, Dispute Resolution
The legal relationship between you and Burlesque Cologne is governed by the laws of the Federal Republic of Germany. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state of the consumer’s habitual residence is not withdrawn (principle of favorability).
Should individual provisions of these terms and conditions be or become wholly or partially invalid, this shall not affect the validity of the rest of the contract. However, if this results in unreasonable hardship for a contracting party, the contract will become invalid as a whole.
